I had my appeal on Thursday. I met with about 10 people who listen to my appeal. Their attorney said that I signed an informed consent and therefore could not really prove that the doctor had told me that these could be “dissolved “with
Kenalog.
That it really is A. He said/he said situation right now. I asked if they had listened to the recorded appointment which was the last appointment and no one had. So, they said they would listen to it before making a decision. At the end of my time, they said to log back in at 5 o’clock to hear all the decisions from the day. I logged in at 4:56 and they were reading the last decision of the day. Mine was one of the first, so I don’t know what their decision is. I guess I will have to wait For the official letter.
It was disappointing that I submitted so much information, including the recording, and they didn’t even listen to it. I questioned the part about being able to speak with someone before an initial decision was made and they said that’s only when it gets kicked up to another level. But at the first level, they just review the documents and whatever I sent in.
I think there were several people there who seemed interested in helping me get justice. The whole informed consent thing is bogus because that’s basically saying they could do anything they want and or I could have any outcome and it would be covered. That’s not how that should work. They said they had it reviewed by a specialist, and that standard of care was met.
