If you think they\'re fake, there\'s likely a cause of action there for a lawsuit (or so I\'d think--not offering legal advice, other disclaimers, etc. . . .).
But fraud is fraud. If he\'s posting fake positive reviews, and that induces people to sign up with him, I don\'t think disclaimers and waivers signed at the time of operation would mitigate liability for false representations. I\'m not a member of the plaintiffs\' bar, nor have I closely followed the stories of what is alleged against Dr. Elist, and so I have no opinion on whether there is merit to the allegations, but I\'d be interested to hear more from those who think they were wronged but also think that there are no options for legal recourse.
